Client had a strike prior for criminal threats. He was arrested for felony strike violations of first degree burglary, assault with a deadly weapon, and other violations that stemmed from a 1-day crime spree. Client adamantly denied his role in the most serious of the charges. Our firm obtained the county’s radio dispatch logs and other police records to show that the police erroneously mistook the identity of our client for another person involved in the crimes. Through persistent negotiations, we were able to persuade the prosecutor to dismiss the new strike allegations, and reduce the case to a misdemeanor, time served offer.
